H-3 Trainee or Special Education Visa
The H-3 visa is a non-immigrant visa that allows foreign nationals to enter the United States temporarily for training or specialized educational exchange programs. This visa serves two primary purposes. First, under the Trainee Program, individuals may come to the U.S. to receive training in fields such as commerce, agriculture, communications, finance, or other professional areas—excluding graduate medical education or training. The training must not be available in the applicant’s home country and cannot be used as a pathway to regular employment in the United States. The U.S. sponsoring organization must provide a structured program that benefits the trainee’s future work outside the U.S.
Second, the Special Education Exchange Visitor Program allows individuals to gain hands-on experience in teaching children with physical, mental, or emotional disabilities. This program is limited to 50 participants per fiscal year. Eligible applicants must be close to completing, or already hold, a degree in special education or have substantial training and experience in the field. The host facility must demonstrate qualified staff and a well-structured program designed to enhance the participant’s skills.
The maximum stay for H-3 trainees is up to two years, while special education exchange visitors may remain in the U.S. for up to 18 months. Spouses and unmarried children under 21 may join the H-3 visa holder on H-4 dependent visas, though they are not permitted to work during their stay in the United States.
